The Anti-Terrorism Act (ATA), 18 U.S.C. § 2333, creates a federal civil cause of action allowing U.S. nationals—and their estates, survivors, or heirs—to recover treble damages, attorneys’ fees, and costs when they are injured “by reason of” an act of international terrorism. Originally enacted in 1992 and significantly strengthened by the Justice Against Sponsors of Terrorism Act (JASTA) in 2016, the ATA now expressly permits claims based on aiding-and-abetting and conspiracy liability. JASTA expanded the statute’s reach by allowing plaintiffs to hold secondary actors accountable when they knowingly provide substantial assistance to designated foreign terrorist organizations or engage in conduct that foreseeably furthers acts of terrorism.
